Terms of Service.

The rules of the road. What you can expect from us and what we expect from you.

1. Acceptance of Terms

By accessing or using any Axene Solutions ("Axene") product or service, including axene.io, mail.axene.io, axene.io, and any associated applications, you agree to be bound by these terms. If you do not agree, do not use our services.

2. Description of Services

Axene provides Axene Mailer, custom apps, and business automations. Our current offers include:

  • Axene Mailer: Email marketing and transactional email delivery.
  • Custom apps: Web apps, portals, dashboards, and internal tools.
  • Business automations: Workflow wiring for reminders, approvals, and handoffs.

3. Accounts

Some services require authentication via Google OAuth. By signing in, you confirm that:

  • You are authorized to use the Google account you sign in with.
  • The information associated with your account is accurate.
  • You are responsible for all activity under your account.

We reserve the right to suspend or terminate accounts that violate these terms.

4. Acceptable Use

You agree not to:

  • Use our services for any unlawful purpose.
  • Send spam, phishing, or malicious content through our platforms.
  • Attempt to gain unauthorized access to our systems or other users' accounts.
  • Interfere with or disrupt our services or infrastructure.
  • Reverse engineer, decompile, or otherwise attempt to extract source code.
  • Use our services to compete with Axene without written permission.

5. Intellectual Property

All Axene products, services, branding, code, and content are the property of Axene Solutions. You may not copy, modify, distribute, or create derivative works based on our products without written permission.

Content you create using our services (emails, meeting notes, invoices, etc.) remains your property. By using our services, you grant us a limited license to store and process this content as needed to provide the service.

6. Pricing and Payments

All prices are listed in Kenyan Shillings (KES). Mailer plans are published, and custom work is quoted by scope.

We reserve the right to change pricing with 30 days' notice to existing subscribers.

7. Data and Privacy

Your use of our services is also governed by our Privacy Policy. By using our services, you consent to the collection and use of information as described in that policy.

8. Service Availability

We aim to maintain high availability for all services but do not guarantee uninterrupted access. We may perform maintenance, updates, or modifications that temporarily affect service availability. We will provide reasonable notice for planned downtime where possible.

9. Limitation of Liability

To the maximum extent permitted by law, Axene Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including loss of data, revenue, or business opportunities.

Our total liability for any claim shall not exceed the amount you paid to Axene in the 12 months preceding the claim.

10. Termination

Either party may terminate the relationship at any time. You may stop using our services and request account deletion. We may suspend or terminate your access if you violate these terms.

Upon termination, we will retain your data for 30 days to allow for export, after which it will be permanently deleted.

11. Governing Law

These terms are governed by the laws of the Republic of Kenya. Any disputes shall be resolved in the courts of Nairobi, Kenya.

12. Changes to These Terms

We may update these terms from time to time. Continued use of our services after changes constitutes acceptance of the updated terms. We will notify users of significant changes via email.
